In the current market realities, when sanctions are applied to Russia and the multifaceted nature of the rapidly changing variables affecting the provision of stable development of the country’s economy influences the business of its subjects of legal relations as well, the legal safety of business in the system of economic security are the most relevant aspects. It is the legal safety of business in the system of economic security that is intended to provide protection from the external and internal threats while ensuring the stable development of both the economy of the country as a whole and its subjects of legal relations.
The authors reveal the interaction of the regulatory authorities and the subjects of legal relations with the emphasis on legal risks, related processes (both external and internal), economic and legal planning (the congruence of the goals of consumers and producers), identification and assessment of risks with the ability to manage them through the special methods and activities, the relevance of operational, tactical and strategic results.
The authors developed and proposed the special model of legal business safety within the system of economic security which is oriented to the immediate reaction to all variables (both external and internal) with the special emphasis on the relevance of the synergetic effect from the impact on these variables and the immediate effectiveness of these economic and legal decisions, by the monitoring of the financial and economic state of a legal entity, its obligations, economic and legal planning and management aimed at the optimization of legal risks and legal control for making the relevant economic and legal decisions.
В действующих рыночных реалиях, когда в отношении России применяются санкции, многогранность быстроменяющихся переменных влияющих на обеспечение стабильного развития экономики страны влияют и на бизнес ее субъектов правоотношений, наиболее актуальными аспектами выступает юридическая безопасность бизнеса в системе экономической безопасности. Именно юридическая безопасность бизнеса в системе экономической безопасности призвана обеспечить защиту от внешних и внутренних угроз с одновременным обеспечением стабильного развития как экономики страны в целом, так и ее субъектов правоотношений.
Авторами раскрывается взаимодействие контрольно-надзорных органов и субъектов правоотношений с акцентом на правовые риски, сопутствующие процессы (как внешние, так и внутренние), экономико-правовое планирование (конгруэнтность целей потребителей и производителей), идентификацию и оценку рисков с возможностью управления ими посредством специальных методов и мероприятий, релевантность оперативного, тактического и стратегического результата.
Разработана и предложена авторами специальная модель юридической безопасности бизнеса в системе экономической безопасности, которая ориентирована на мгновенное реагирование на все переменны (как внешние, так и внутреннее) с особым акцентом на релевантность синергетического эффекта от воздействия на эти переменные и непосредственной эффективности этих экономико-правовых решений, посредством мониторинга финансово-хозяйственного состояния субъекта правоотношения, его обязательств, экономико-правовое планирование и управление, нацеленное на оптимизацию правовых рисков и юридический контроль в целях принятия релевантного экономико-правового решения.
